When can a Maryland storage facility throw away property left after nonrenewal?

Last updated October 17, 2026 · Last verified October 17, 2026 against the official sources linked below · General information, not legal advice

Quick answer

Only after two waiting periods. Since July 1, 2026, the operator must first give at least 30 days after the nonrenewal notice and until the term ends to remove property, then send a notice of intent to dispose at least 10 days before disposing, in person, by email or by verified mail (Md. Code, Commercial Law 18-502(d)-(e)). An emailed notice with no reply or delivery confirmation in 5 days needs a second notice by verified mail.

FAQ

Is this the same as a Maryland storage lien sale?

No. These are nonrenewal disposal rules in 18-502. Sales for unpaid rent follow the lien rules in 18-504 and nearby sections.

Does the 10-day clock start before the 30 days end?

No. 18-502(e)(2) says the notice of intent to dispose is sent after the removal time under (d) has elapsed, and at least 10 days before disposal.

Does the rental agreement need to mention nonrenewal?

Yes. Under 18-503(b)(5) as amended, the bold statement in the agreement must say the operator will send written notice to remove property if it does not renew.

Is this legal advice?

No. General information only.
