Illinois driver’s-license job posting law (HB 4758): posting compliance kit

Do your Illinois job ads say “valid driver’s license required”? From January 1, 2027, that needs a reason, and an unfixed posting can cost up to $1,500 for every further 30 days.

Quick answer

From January 1, 2027, Illinois employers with 15 or more employees and employment agencies may not state in a job posting that an applicant must have a valid driver’s license unless driving is one of the essential functions of the job and a business necessity. When it is, the posting must briefly explain why (820 ILCS 75/17, added by HB 4758). The Illinois Department of Labor enforces it: a written warning and 30 days to fix, then up to $500, then up to $1,500 more, then up to $1,500 for every further 30 days without compliance (820 ILCS 75/20).

Frequently asked questions

When does the Illinois driver's license job posting rule start?

January 1, 2027. HB 4758 (Public Act 104-0776) adds Section 17 to the Job Opportunities for Qualified Applicants Act (820 ILCS 75/17), effective January 1, 2027.

Who is covered?

Employers with 15 or more employees in the current or preceding calendar year, and employment agencies, as defined in 820 ILCS 75/10 as amended by HB 4758. This page does not decide whether your business is covered.

Can I still require a license or CDL for driving jobs?

Yes, if driving is one of the essential functions of the posted job and requiring a license is a business necessity. In that case the posting must include a brief description explaining why a valid driver's license is required (820 ILCS 75/17).

What are the penalties?

The Illinois Department of Labor enforces the Act. Under 820 ILCS 75/20: a first violation gets a written warning and 30 days to remedy; if not remedied within 30 days (or a second violation), a civil penalty of up to $500; if not remedied within 60 days (or a third violation), an additional civil penalty of up to $1,500; and if not remedied within 90 days, an additional civil penalty of up to $1,500 for every 30 days that passes without compliance.

Does it cover phrases like “reliable transportation”?

The statute targets statements that an applicant must have a valid driver’s license. It does not list other phrases. The kit flags transport-related wording for you to review; it does not decide whether a phrase counts.

Is this legal advice?

No. This page and the kit are general information and blank templates built from the public law. They do not decide whether driving is an essential function or a business necessity for a given job, do not address ADA, Illinois Human Rights Act or other hiring laws, and buying a kit does not create a lawyer-client relationship.
