SB 766 3-day cancel deadline calculator (California used cars)

Quick answer

The 3-day right to cancel runs three calendar days starting the day after the contract is signed and ends at the dealership’s close of business on day 3; if day 3 is a closed day, it moves to the next open day (Civ. Code §1784.31(i)). Enter the signing date below.

How the SB 766 3-day period is counted

The cancel deadline is close of business on the third calendar day after signing, moved to the next open day if day 3 falls on a day the dealership is closed, per Cal. Civ. Code §1784.31(i):

  1. Day 1 is the calendar day after the purchase or lease is executed (§1784.31(i)(1)).
  2. Count three calendar days (weekends count).
  3. If day 3 is a day the dealership is closed to the public, the period extends to the next day it is open (§1784.31(i)(2)).
  4. The right ends at the dealership’s close of business on that last day (§1784.31(i)(3)).

The tool only knows the weekly closed days and the one extra date you enter. It does not apply the other §1784.43 limits: the vehicle must be a used vehicle (not a motorcycle) sold or leased at retail for $50,000 or less, and the right ends once it has been driven more than 400 miles after signing.

Frequently asked questions

How do I count the SB 766 3-day right to cancel?

Under Cal. Civ. Code §1784.31(i), count three calendar days starting the calendar day after the purchase or lease is executed. If the third day falls on a day the dealership is closed to the public, the period extends to the next day the dealership is open. The right ends at the close of business on that last day.

Does the day of signing count?

No. Day 1 is the calendar day after the contract is executed (§1784.31(i)(1)). A contract signed on a Monday runs Tuesday, Wednesday and Thursday.

What if the dealership is closed on the third day?

The period extends to the next day the dealership is open to the public (§1784.31(i)(2)). Only the third day is checked: closures on day 1 or day 2 do not add time. Example: signed Thursday, days are Friday, Saturday, Sunday; if the dealer is closed Sundays, the deadline is close of business Monday.

What time does the right to cancel end?

At the close of business on the last day (§1784.31(i)(3)). The law does not set a clock time, so it depends on the dealership’s own business hours. The buyer must personally deliver the vehicle and items to the dealer during business hours (§1784.43(b)(6)).

Is this legal advice?

No. This calculator is a general calendar helper based on the public counting rule. It does not decide whether a sale qualifies (for example, price $50,000 or less, not a motorcycle, 400 miles or fewer), and it only knows the closed days you tick.
