Last updated October 17, 2026 · Last verified October 17, 2026 against the official sources linked below · General information, not legal advice

Quick answer

Yes. Since January 1, 2026, leaving a mandatory fee out of an online price breaks ORS 646A.087 and is an unlawful trade practice (ORS 646.608(1)(cccc)). A customer who loses money from a willful violation can sue for actual damages or $200, whichever is greater, and a court may add punitive damages (ORS 646.638(1)). The suit must be filed within one year of discovering the practice. The state can also seek up to $25,000 per willful violation.
